Terms of Service

1. Agreement to Terms

By accessing or using Worduel ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may modify these terms at any time; continued use constitutes acceptance of changes.

2. Eligibility

To use Worduel, you must:

  • Be at least 18 years of age (or the age of majority in your jurisdiction)
  • Be located in a jurisdiction where skill-based gaming for money is legal
  • Not be a resident of a Restricted Territory (see Section 3)
  • Have the legal capacity to enter into a binding agreement
  • Not be self-excluded from gaming platforms

By using Worduel, you represent and warrant that you meet all eligibility requirements. We rely on your self-attestation but reserve the right to verify eligibility at any time.

3. Restricted Territories

Real-money gameplay is NOT available in the following U.S. states and territories due to local regulations on skill-based gaming:

Arizona, Arkansas, Connecticut, Delaware, Louisiana, Montana, South Carolina, South Dakota, Tennessee, and Puerto Rico.

This list may change as laws evolve. Users are responsible for knowing and complying with local laws. Attempting to circumvent geo-restrictions (e.g., using VPNs) is a violation of these terms and grounds for account termination and forfeiture of funds.

4. Skill-Based Gaming Disclosure

Worduel is a skill-based game. The outcome of each match is determined by player skill, not chance. Both players receive the same puzzle and compete on equal terms. The player who solves the puzzle in fewer guesses wins. If both players solve it in the same number of guesses, the faster player wins.

Worduel is NOT gambling. No element of chance determines match outcomes. However, skill-based gaming for money may still be regulated in your jurisdiction.

5. Account Registration

Accounts are created and authenticated through Whop. By creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activity under your account
  • Notify us immediately of any unauthorized access
  • Maintain only one account per person

6. Deposits and Withdrawals

Worduel uses real USD for all bets and payouts.

Deposits:

  • Deposits are made through Whop's secure payment system
  • All deposits are final and non-refundable except as required by law
  • Minimum deposit: $10

Withdrawals:

  • Withdrawals are processed through Whop's payout system
  • Whop handles all KYC (Know Your Customer) verification for payouts
  • You must complete Whop's identity verification before receiving payouts
  • Minimum withdrawal: $10
  • A 3% processing fee applies to all withdrawals
  • You must wager 1x your deposited amount before withdrawing
  • Processing time: 1-5 business days

We reserve the right to delay or refuse withdrawals pending fraud review or eligibility verification.

6.1 Fraud Prevention and Unauthorized Transactions

We reserve the right to delay, reverse, or refuse to honor any deposit, credit, or balance that:

  • Was obtained through fraudulent, unauthorized, or illegal means
  • Results from exploitation of system vulnerabilities, bugs, or errors
  • Was not legitimately processed through our official payment provider (Whop)
  • Appears suspicious based on our fraud detection systems
  • Is associated with chargebacks, disputes, or payment reversals
  • Exceeds our daily deposit limits or triggers fraud alerts

Account Consequences: Users who attempt to exploit payment systems, forge transactions, or otherwise fraudulently obtain credits will have their accounts immediately suspended, all balances forfeited, and may be reported to appropriate law enforcement authorities.

No Obligation to Honor: We are not obligated to honor any credits, winnings, or balances that were not legitimately obtained through our official payment channels. In the event of suspected fraud, we may freeze accounts pending investigation without prior notice.

7. Game Rules and Fees

Gameplay:

  • Both players bet the same amount
  • Both players receive the identical secret word
  • The player who solves the word in fewer guesses wins
  • If both players use the same number of guesses, the faster player wins
  • Matches expire after 24 hours if not completed—bets are refunded
  • You cannot play against yourself or collude with opponents

Fees:

  • Platform rake: 10% of the pot (deducted from winner's payout)
  • Withdrawal fee: 3%
  • No fees on deposits

8. Fair Play and Prohibited Conduct

You agree NOT to:

  • Use bots, scripts, or automated tools to play
  • Use external word-solving tools or databases during matches
  • Collude with other players or share puzzle answers
  • Create multiple accounts to exploit promotions or matchmaking
  • Exploit bugs, glitches, or vulnerabilities
  • Circumvent geo-restrictions using VPNs or location spoofing
  • Engage in money laundering or fraudulent activity
  • Harass, threaten, or abuse other users
  • Use disposable, temporary, or anonymous email services

Violations may result in immediate account suspension, forfeiture of balance, and permanent ban. We reserve the right to investigate suspicious activity.

8.1 Disposable Email Restrictions

Accounts registered with disposable, temporary, or anonymous email services (including but not limited to: passinbox.com, passmail.com, tempmail.com, mailinator.com, guerrillamail.com, and similar services) are subject to the following restrictions:

  • All deposits and balances may be forfeited without notice
  • Withdrawals are permanently disabled
  • Account may be suspended or terminated at any time
  • No refunds or compensation will be provided

This policy exists to prevent fraud, Sybil attacks, and exploitation of our platform. If you believe your account was flagged in error, contact support with proof of a legitimate, permanent email address.

9. Intellectual Property

Worduel and all associated trademarks, logos, and content are owned by us. You may not copy, modify, distribute, or create derivative works without permission.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOU USE THE SERVICE AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS OR $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold harmless Worduel and its affiliates from any claims, damages, losses, or expenses arising from your use of the Service, violation of these terms, or infringement of any third-party rights.

13. Dispute Resolution

Any disputes arising from these terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive the right to participate in class actions.

Small claims court actions and injunctive relief for intellectual property matters are exempt from arbitration.

14. Governing Law

These terms shall be governed by the laws of the State of Delaware, without regard to conflict of law principles.

15. Termination

We may suspend or terminate your account at any time for any reason, including violation of these terms. Upon termination, your right to use the Service ceases immediately. Balances may be refunded at our discretion, minus any fees owed.
